Clinical Negligence


The Clinical Negligence Team at Christian Khan has over 26 years experience of helping the victim of medical accidents

Louise Christian and Peter Flory are members of the Law Society's Clinical Negligence Accreditation Scheme.

Josie Robinson has considerable clinical negligence experience and has recently been recognised by the Legal 500 as "an associate to watch" who is "highly rated by her peers". The firm is a member of the AvMA Lawyers Service (Action Against Medical Accidents) and all solicitors are members of APIL (Association of Personal Injury Lawyers).

We hold a Legal Services Commission (LSC) Franchise to conduct clinical negligence work (previously referred to as Legal Aid) which requires the firm to meet high service standards for client care. Many firms do not hold this LSC franchise to conduct clinical negligence work and it is in recognition of the technical expertise of the Christian Khan Clinical Negligence team that we hold this franchise.

Christian Khan has over twenty six years experience of representing some of the most vulnerable members of our society. Our representation of the victims of medical accidents is part of that work. We believe the best way to achieve a successful outcome in clinical negligence claims is to offer technical expertise of the highest kind and to listen carefully and with great compassion to those who seek our help.

We believe we achieve this by offering experienced medical negligence solicitors some of whom are also clinically qualified. Peter Flory qualified and practised as a First Level Registered Nurse and Josie Robinson qualified and practised as state Registered Physiotherapist. Clinical negligence work is complex and so understanding the medicine helps our lawyers represent the victims of clinical negligence with whom we work very closely in support of their claims

Christian Khan is proud of its work acting for bereaved families at inquests including in matters relating to the death of persons detained under the Mental Health Act and more generally where we have achieved many satisfactory outcomes for the bereaved.

What is clinical negligence / medical negligence?
To prove a claim for clinical negligence / medical negligence the following is required:-
1. An independent medical expert must support the claim that there has been a breach of duty, i.e. that the standard of care provided by the health practitioner has fallen below a reasonable standard.
2. Alternatively, a court could reject a defence of reasonable care on the basis it has no logical foundation.
3. Finally, an independent medical expert must also support the view that the breach of duty care is the cause of the damage alleged. This is legally referred to as 'causation'.

Without all these elements, a clinical negligence claim cannot succeed

The time limit for bringing a claim for clinical negligence?
Usually a clinical negligence claim must be brought within three years of the date the claimant knows (or ought to have known) that s/he may have been injured because of clinical negligence. For a child the three year time limit does not begin until the child is 18. For an incapacitated person, the time will only start to run if/when legal capacity is regained. From a practical point of view the sooner a claim is investigated the better as evidence fades with time.

How will I pay for my case?
At Christian Khan we recognise that legal costs are often a source of concern for the general public. Few people have the ability to pay privately. We can consider a number of funding alternatives including Conditional Fee Agreements ("No Win, No Fees"), Legal Aid and Before the Event insurance.

How long does a clinical negligence claim take?
Clinical negligence cases can be difficult and may take several years to conclude depending on their complexity. We aim to alleviate the burden of litigation and allow you to continue with your normal life as much as possible.
