Motoring offences: Speeding, drink driving, careless driving

What are some of the common motoring offences?

The Road Traffic Act 1988 is the main piece of legislation that covers motoring offences. It defines a number of safety provisions and explains the different violations and driving restrictions.

Here are a few of the common road traffic infringements:

  • Careless driving - Driving without due care and attention is a crime due to the safety breaches it may cause. Typically this occurs when the driver is doing something else while operating their vehicle - such as talking on a mobile phone, applying makeup or reading a map. Inconsiderate, aggressive or dangerous driving are other infringements.
  • Speeding - If you've been caught going over the legal speed limit, it's likely that you've been issued with a speeding ticket, which includes a fixed monetary penalty. In certain cases, you may receive a speeding summons, in which case you'll need to appear in court.
  • Failing to stop after an accident - If you have been involved in an accident, you must stop to exchange details with the other parties involved and the incident must be reported to the police as soon as possible - within 24 hours.
  • Drink driving - These violations generally involve a person operating a vehicle while under the influence of alcohol, but charges can also be brought against you if you have been using other drugs that impair your abilities. In addition, it is an offence to refuse to provide a specimen (blood, breath or urine) for analysis to determine your blood alcohol content.


Of course, most of these transgressions will result in points being added to your driving licence. If you accumulate more than 12 points, you'll be faced with a driving ban. With certain road traffic offences, you will have an immediate suspension of your licence.
